A book about lawyers and the law written by a Professor of Law, Yale University, and an important read in demystifying the Law and the actions and intentions of lawyers. It is not what you think!!! Here is an excerpt from the Preface of the book:-
'No lawyer will like this book. It isn't written for lawyers. It is written for the average man and its purpose is to try to plant in his head, at the least, a seed of skepticism about the whole legal profession, its works and its ways.
In case anyone should be interested, I got my own skepticism early. Before I ever studied law I used to argue occasionally with lawyers - a foolish thing to do at any time. When, as frequently happened, they couldn't explain their legal points so that they made any sense to me I brashly began to suspect that maybe they didn't make any sense at all. But I couldn't know. One of the reasons I went to law school was to try to find out.'
Notice of Removal of Implied Right of Access. In an editable word document. Having this notice on your front door or garden gate prevents them from entering your property. Backed up by lots of case law. Make sure you laminate it to protect it from the weather. Or you can have it printed onto vinyl at your local printer or sign maker.
"A debtor can remove right of implied access by displaying a notice at the entrance". This was endorsed by Lord Justice Donaldson in the case of Lambert v Roberts [1981] 72 Cr App R 223 - "...and placing such a notice is akin to a closed door but it also prevents a bailiff entering the garden or driveway...", Knox v Anderton [1983] Crim LR 115 or R. v Leroy Roberts [2003] EWCA Crim 2753
"Debtors can also remove implied right of access to property by telling him to leave", Davis v Lisle [1936] 2 KB 434 similarly, McArdle v Wallace [1964] 108 Sol Jo 483
Weaver v Bush [1795] 8TR, Simpson v Morris [1813] 4 Taunt 821, Polkinhorne v Wright [1845] 8QB 197 -
"A debtor can use an equal amount of force to resist a bailiff from gaining entry."
"Another occupier of the premises or an employee may also take these steps" Hall v Davis [1825] 2 C&P 33.
To save space on this page 20 more case citations in your favour can be downloaded here. This PDF also has case law on police attendance and can be used to pick and choose only those case citations you would like to use in your documentation or just for having the knowledge about how to deal with them when they turn up at your door or when they send you letters. The upshot is that YOU are in control, not the bailiffs.
One thing to note... it does not matter how old a case is, if it is listed in the document above it is settled law and applies to your situation today.
The following video is a of a real case that has been done after much research. One can copy this example if in a bind with your local Council. I will be adding all the statutes pointed out in the video over time, but in the meantime please make notes as you watch this 32 minute video which is extremely good and lays out in plain language, with the paperwork for proof, how this is all a fraud. For those who are new to this type of information it is eye-opening and will be very hard to believe.
This document can be used as a template, with relevant changes to the company name, company number (you can get the company numbers from the government website here) and names of people being harrassed, to stop all fraudulent Council Tax Liability Orders from being collected on. You can download an editable version of this document here.
Council Tax Info - 93 pages chock full of information on not only the council tax fraud but also on all aspects that are involved with it; corporations, legislation, persons, personal data, obligation to pay, Direct Debit Guarantee, debt collectors, trespassers case law, court summons, magistrates' court, liability orders, warrants, county courts, Debt Collectors, Vulnerable Notice, police, legislation to quote to the council, the notice process, how to make a court claim under GDPR, liens, and the Herefordshire Case Study.
Local Government Finance Act 1992 (UK) - the act that all councils use to justify charging you for council tax. But there's nothing in the act that says men or women have to pay - it only applies to persons. It also violates the Bill of Rights Act 1688/89 in that they don't provide an invoice or have a contract with you.
Local Government Act 1888 (UK) - this act states in Section 79 part 2 (page 70 of the PDF):
(2.) All duties and liabilities of the inhabitants of a county shall become and be duties and liabilities of the council of such county.
Well, there you go!! Council Tax should be paid for by the Council!!!!! Even though people have brought this into court they ignore it - which shows you how crminal the 'government' is. No one wants to give up on being able to fleece you who work in government (council or Parliament).
If they turn up at your house saying they have a warrant, take a look and see if it's signed with a 'wet ink' signature. If it isn't it's not valid.
A warrant in these circumstances can only be based on Health and Safety (Gas Act 1954).
If it is not signed, then it's not a warrant and they are liable for:
They need your consent!
R. v Robert White [2022] -
"The Police Sergeant had unlawfully entered the defendant's home, and was essentially a 'trespasser and unwelcome intruder' ... It did not matter the sergeant was a police officer, the defendant was entitled to remove him with reasonable force."
Carmel Butler's Memorandum of 2009 Source - An extraordinary document that is the transcript of Carmel Butler's speech in the Houses of Parliament in 2009 that goes into great detail about the fraud occurring in the mortgage industry. A company has been using the information contained herein to discharge mortgages with a 100% track record since 2009. This document was downloaded directly from the UK's legislative website. The information in this document can be applied to the US, Canada, Australia, New Zealand and most of the countries that have a central bank as part of the Federal Reserve system (Syria, Iran, North Korea and possibly Russia do not have the same banking systems so this info will not apply there).
How to take control of a court room. A one page script that one needs to learn to bring any court case to a standstill. It breaks the assumption that the courts work on that they have power of attorney over you. They do (due to you volunteering to be in court) until you remove it by asking the question in the document. Very, very powerful and extremely effective. But you must stand your ground when following through with this as they will do everything they can, short of physically assaulting you, to scare you into bowing down or caving in to them and give them jurisdiction over you.
The 12 presumptions that the courts work off of.
My dad's credit card debt is discharged with 1 letter!
Courts Act 1971 (UK) - which in section 1 part 2 abolishes courts of assize and in section 3 abolishes courts of quarter sessions. What are these courts? Your local magistrates courts!!! I had a hard time understanding how it is that these courts are still fleecing people. They are still around doing what they do because it benefits them to keep on doing what they're doing. This gem was revealed to a close friend of mine by a Queen's Bench Barrister.
